Answer: No — only if the balconies have wood railings or framing
SB 326, also called “The Balcony Bill”, requires condo HOAs to have their balconies, decks, and elevated walkways inspected by a structural engineer every nine years — but only if those structures have wood framing. All-concrete buildings are off the hook.
For buyers, it's simple: If there’s wood, get the HOA's inspection report before you offer or before you remove contingencies. If there's no report in the disclosures, or the report flagged problems, find out what repairs are coming and who's paying for them. Besides potentially costing you in surprise assessments, this can also affect your loan if you have one!
